The operators or owners of hotpussypics.com are not the "producers" (either primary or secondary) of any material that may be explicitly sexual in nature, regardless of authenticity, that is found on that website. Regarding such, the operators of hotpussypics.com limit their undertakings to the transmission, storage, retrieval, hosting and/or formatting of the content, be it depictions of explicit or of simulated sexual activity, that is provided by third-party users of the website. All parts of hotpussypics.com on which user-supplied content appears are under said users’ control. The operators are consequently exempt from compliance with Section 2257 records keeping and labeling obligations pursuant to 28 C.F.R. §75.1(c)(4). Any content that is believed to be illegal, obscene, harmful, harassing, defamatory or in any manner incompatible with the terms of use and policies of the website, may be removed at the sole discretion of the operator or owner, in keeping with 18 U.S.C. § 2257(h)(2)(B)(v) and 47 U.S.C. § 230(c).
With regard to any visual depictions appearing on the website, for which the operators of the website may be considered “producers” or “secondary producers,” such depictions are exempt from the provisions of 18 U.S.C. §§2257, 2257A and 28 C.F.R. 75 because they do not portray actual sexually explicit behavior as specifically set out in 18 U.S.C §2256 (2) (A)(i)-(iv); they do not portray depictions of the genitals or pubic area created after July 27, 2006; they do not portray simulated sexually explicit behavior created after the effective date of Title 18 U.S.C. §2257A; or, they were created prior to July 3, 1995.
